Who we are

This website is operated by Hearth and Hound ("we", "us", "our"). By browsing or buying from this store you agree to these terms. If you do not agree with them, please do not use the site.

Your rights under the Australian Consumer Law come first

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where anything on this page conflicts with those rights, those rights apply.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. Our refund policy sets out how we handle returns alongside those rights.

Using this site

You must be at least 18, or have the consent of a parent or guardian, to place an order.
You agree not to use the site for any unlawful purpose, or to interfere with its operation or security.
We may refuse service, or cancel and refund an order, where we reasonably believe it was placed fraudulently or in breach of these terms.

Products, prices and availability

All prices are in Australian dollars, and the total including shipping is shown at checkout before you pay.
We ship within Australia only. See our shipping policy.
We try to show colours and dimensions accurately, but screens vary and photographs are a guide. The measurements published on each product page are the figures to rely on. Where we do not have a figure confirmed by the manufacturer, we say so rather than estimate it.
Stock can change. If we cannot fulfil an order after you have paid, we will contact you and refund you in full.
We may change prices, or add and withdraw products, at any time. A change will never affect an order we have already accepted.

Orders

Placing an order is an offer to buy. We accept it when we send you a dispatch confirmation, not when you receive the automatic order confirmation email.

If an obvious pricing or description error occurs, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund. We will not simply charge you the difference.

Our beds are made and dispatched by our manufacturing partners overseas and sent directly to you. That does not change your position: we are the seller, and we are responsible to you for the goods.

Payment

Payments are processed by Shopify and its payment providers. We never see or store your full card details. You confirm you are authorised to use the payment method you provide.

Content on this site

The text, photographs, diagrams and design on this site belong to us or are used with permission, and may not be copied or republished commercially without our written consent. You are welcome to link to us.

Availability and delivery estimates

We aim to keep the site available and accurate, but we do not guarantee uninterrupted access, and we may change or withdraw parts of it. Delivery windows are estimates: carriers, customs and weather are outside our control. Where a delay is our fault, or the goods fail a consumer guarantee, the rights described above apply.

Liability

Subject to your rights under the Australian Consumer Law, and to the extent the law allows, our liability for any claim connected with an order is limited to replacing the goods, supplying equivalent goods, or refunding what you paid for them. We are not liable for loss that was not reasonably foreseeable.

Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state. Nothing here prevents you from bringing a claim in any tribunal or court the law entitles you to use.
